General Terms and Conditions of Use

The website https://www.qair.energy (hereinafter the ‘Site’), published by the company Qair International SAS (hereinafter ‘Qair,’ ‘we,’ or ‘our’), presents the activities of the Qair Group.

Accessing, viewing, browsing, and/or using the Site and its services constitute full and unconditional acceptance of these terms of use (hereinafter ‘Terms of Use’), which aim to define the terms of use of the Site and its services by anyone accessing, viewing, browsing, and/or using all or part of the Site and its services (hereinafter ‘User’).

Therefore, before using the Site and its services, the User is invited to read these Terms of Use. If the User refuses any or all of any provision of these Terms of Use, they are requested not to use it.

These Terms of Use are accessible at any time on the Site and will prevail, if applicable, over any other version or conflicting document.

ACCESS TO THE SITE AND SERVICES
Access to the Site and its services is technically possible twenty-four (24) hours a day, seven (7) days a week, subject to the occurrence of a force majeure event, possible malfunctions, or any maintenance operation necessary for the proper functioning of the Site and its services.

In any case, the User acknowledges having the competence and means necessary to access and use the Site and its services. In this regard, the User must have a computer, a mobile phone, a tablet, or any other device with internet access, whose settings allow the proper functioning of the Site and its services.

In general, the User declares to be aware of the risks associated with browsing on the Internet and using online services and accepts them. The User acknowledges in particular that the information that transits or is stored there may be intercepted or altered independently of Qair’s will.

In this regard, it is strongly recommended for the User to take all necessary precautions to guard against the effects of possible computer hacking, notably by adopting a secure and appropriate computer configuration for their computer, mobile phone, tablet, or any other device used (for example, by implementing regularly updated virus detection software).

SERVICES OFFERED ON THE SITE
2.1. Access conditions to services offered on the Site

To benefit from the services offered on the Site, the User must:

have the capacity and required quality to benefit from the Site’s services;
use the Site and its services in accordance with these Terms of Use.
Furthermore, access to the services offered on the Site sometimes requires filling in the mandatory fields of the form associated with the desired service (e.g., contact form, job application form). The User guarantees the truthfulness and accuracy of the information provided in this context. To learn more about the use of their personal data by Qair within the framework of the Site and how to exercise their rights on this subject, the User is invited to consult the personal data protection policy.

2.2. Services offered on the Site

From the Site, the User can, among other things:

access information available on the Qair Group and its activities;
contact Qair for any information request;
consult available job offers within the Qair Group and apply if necessary.

GENERAL USER OBLIGATIONS
The User undertakes in particular:

not to use the Site and its services for commercial, prospecting, solicitation, or advertising purposes;
any behavior likely to harm the integrity, operation, or security of the information system at the base of the Site and its services;
any intrusion or attempt to intrude into the information systems of the Qair Group;
any attack or attempt to attack the security measures of the Site;
any collection, extraction, or use, in any way whatsoever, of the information present on the Site;
and more generally, any act likely to harm the rights and interests of the Qair Group or third parties.
In the event of a breach of these Terms of Use or applicable law, including any unauthorized use of the Site and its services identified by Qair, the latter reserves the right to terminate this contractual relationship, automatically and without notice or compensation, and to block any future access by the User to all or part of the Site and its services.

INTELLECTUAL PROPERTY
The Site and all elements composing it or made available to Users, including trademarks, logos, photographs, programs, source codes, object codes, data, databases, animated or non-animated images, sounds, drawings, graphics, videos, texts, arrangement, appearance, structure, as well as any other element not related to hypertext links to third-party sites, are the property of Qair or are subject to a license granted to it by any holder of intellectual property rights.

All these elements are subject to the provisions of French and international regulations applicable to intellectual property, including the Intellectual Property Code, and, consequently, are protected against any unauthorized use by law or these Terms of Use under penalty – in case of breach – of legal action.

Qair grants the User, on a personal, non-exclusive, and free basis, the right to consult and use the Site and its services for their own use and within the strict framework of the operations authorized under these Terms of Use.

Subject to the rights of use granted to the User by Qair, the use of the Site and its services does not imply any license or assignment of rights relating to the elements of the Site in favor of the User. In particular, any copying, reproduction, representation, adaptation, modification, complete or partial dissemination of the Site, as well as all or part of its content, by any means and on any medium, is unlawful without prior, express, and written authorization from Qair or the holder of intellectual property rights.

Non-compliance with these provisions, especially for commercial exploitation, may result in legal action for infringement and/or action for unfair competition and/or parasitism by the rights holders concerned. This is without prejudice to Qair’s other rights, including the right to obtain compensation for damages suffered.

LIABILITY
The Site is provided to the User free of charge. Although Qair strives to provide a reliable Site, Qair does not guarantee that it is free of errors, inaccuracies, or omissions, periods of unavailability, vulnerabilities, or defects. Furthermore, Qair does not guarantee the accuracy, quality, legality, or suitability for a particular purpose of the Site, the services offered, and the content published on it. Therefore, the User acknowledges using the Site, the services offered, and the content published on it under their exclusive responsibility.

Under no circumstances can the information available on the Site replace the advice and diagnosis of a healthcare professional, nor dispense with a medical consultation if necessary. Any decision made based on the information available on the Site will solely engage its author; Qair is therefore not responsible for these decisions, directly or indirectly, or for any damages, direct or indirect, resulting from them.

Furthermore, Qair cannot be held responsible for direct or indirect damages that may result from:

any malfunction or contamination of the computer, mobile phone, tablet, or any other equipment used by the User during or after browsing the Site, impossibility of access, or improper use attributable to these devices, the internet service provider, internet congestion, or any other reason beyond Qair’s control;
the electronic or telephone communication costs induced by the use of these devices, which are the exclusive responsibility of the User and will not be borne by Qair;
any interruption, temporary or permanent, of all or part of the Site’s features, especially in the case of maintenance, modification, or updating of the Site, technical incidents, and, more generally, in the event of an event outside Qair’s control;
any consequences that may arise from the contents of third-party websites to which the hypertext links on the Site may lead;
any potential indirect damages suffered by the User;
any harm suffered by the User or a third party resulting from the non-compliant use of the Site according to these Terms of Use;
any failure to comply with the obligations set out in these Terms of Use that is due to or originates from a fortuitous event or force majeure as defined by Article 1218 of the Civil Code.
In the event that Qair is held responsible for damage not provided for in this article, its liability will be limited to certain, actual, and direct damages.

Subsequently, under no circumstances can Qair, its representatives, and its partners be held responsible for indirect damages resulting from the use of the Site, the services offered, and the content published on it, including loss of profit, loss of opportunity, or damages arising from the loss of data caused by the inability to use the Site and its services.

MODIFICATION
These Terms of Use are dated precisely and may be modified and updated by Qair at any time, especially in the event of changes to the Site or applicable law.

The applicable Terms of Use are those published on the Site at the time of the User’s access to the Site. Therefore, the User is invited to consult the Terms of Use each time they access the Site.

This version of the Terms of Use replaces all previous versions.

CESSATION OF THE SITE

Qair reserves the right to interrupt, temporarily or permanently, access to all or part of the Site or the services offered, especially in the event of the cessation of the activity related to the provision of the Site or in the event of collective proceedings.

ASSIGNMENT

Subject to applicable law, the User agrees that these Terms of Use binding them to Qair may be assigned, transferred, or contributed in any way. In the event of the transfer of Qair to a third party, these Terms of Use binding the User to Qair will be automatically transferred to the assignee.

HYPERTEXT LINKS

The Site may include hypertext links to external sites or sources other than those published by Qair. As Qair cannot control these external sites and sources, Qair cannot be held responsible for making these external sites and sources available and thus declines all responsibility for the content, advertisements, products, services, or any other material available on or from these external sites or sources. Therefore, the decision to activate hypertext links belongs exclusively to the User.

Qair reminds the User that non-affiliated external sites or sources are subject to their own terms of use.
